Acceptable Use Policy

Last updated April 27, 2026

DRAFT — requires legal review before launch. This is template seed copy from a public SaaS source; it has not been reviewed by counsel. Do not rely on it as legal advice.

1. Purpose

This Acceptable Use Policy ("AUP") sets out what you may and may not do when using Marketing Operator. The AUP is incorporated into our Terms of Service — violating it is a breach of those Terms and may result in suspension or termination of your account.

We can't list every prohibited use; the spirit of the AUP is "use the Service in good faith for legitimate marketing work, do not endanger other users or the Service itself, and do not break the law".

2. Prohibited content and conduct

You agree not to use the Service to create, store, transmit, or generate:

  • Illegal content — including, but not limited to, content that infringes intellectual property rights, defames an identifiable person, violates export controls or sanctions, or constitutes child sexual abuse material (CSAM).
  • Harmful content — content that promotes violence, terrorism, self-harm, or threats against individuals or groups; content that constitutes harassment, hate speech, or targeted abuse on the basis of any protected characteristic.
  • Deceptive or fraudulent content — phishing pages, fake invoices, "scareware", impersonation of real people or organisations without authorisation, content designed to mislead consumers about the nature of a product or service.
  • Sexually explicit content involving real people without consent, deepfake-style identity impersonation, non-consensual intimate imagery, or any content that violates the dignity of an identifiable person.
  • Spam or unsolicited commercial communication — bulk-generated content intended for unsolicited distribution, content optimised for SEO manipulation rather than genuine user value, or content that violates anti-spam law (CAN-SPAM, CASL, ePrivacy).

3. Scraping and research conduct

The Service includes a research feature that fetches public web pages and Meta ad libraries on your behalf. You agree:

  • You will not submit URLs that you know to be private, behind authentication, or otherwise off-limits to the public web. Submitting authenticated or paywalled content is your responsibility, not ours.
  • You will not use the research feature to scrape sites in violation of their robots.txt, terms of service, or rate-limit signals. Our scraper honours these signals; you must not attempt to bypass them by repeated submissions or pattern manipulation.
  • You will not use the Service to scrape personal data subject to GDPR, CCPA, or comparable privacy law without a lawful basis you can document.
  • You will not use the Service to participate in or enable a coordinated denial-of-service attack against any third-party site.

4. Security and abuse

You agree not to:

  • Attempt to gain unauthorised access to any account, system, or data — yours or anyone else's.
  • Probe, scan, or test the vulnerability of the Service (other than under our published responsible-disclosure policy at support@marketingoperator.ai).
  • Attempt to bypass, evade, or remove rate limits, content moderation, billing enforcement, or other technical restrictions.
  • Attempt to extract system prompts, model weights, training data, or other users' Customer Content from AI generation results.
  • Use automated tools (bots, scrapers, crawlers) to access the Service except via documented APIs and within the rate limits we publish.
  • Reverse engineer, decompile, or disassemble the Service or any component of it, except where the law expressly permits this despite a contractual prohibition.

5. Account use

You agree to:

  • Use the Service only for purposes you have a lawful right to pursue.
  • Provide accurate registration information and update it when it changes.
  • Keep your password secure; not share your account with third parties.
  • Take responsibility for all activity under your account, including activity by team members you invite.
  • Comply with the AI provider terms that apply to outputs (linked from our Privacy Policy).

6. Reporting abuse

If you observe content or conduct on the Service that violates this AUP, report it to support@marketingoperator.ai. Include the URL, screenshots, and any context that helps us investigate. We treat abuse reports as urgent and aim to acknowledge them within one business day.

7. Enforcement

We may, at our sole discretion and without prior notice, take any of the following actions in response to a violation:

  • Remove or quarantine the offending content.
  • Suspend the offending account temporarily.
  • Terminate the offending account and any associated team accounts, with no refund.
  • Report the violation to law enforcement, regulators, or affected third parties.
  • Cooperate with subpoenas, court orders, or other legal process.

We aim to apply enforcement proportionally — minor and apparently inadvertent violations typically receive a warning before suspension; severe violations (e.g. CSAM, attempted unauthorised access to other accounts) result in immediate termination and law-enforcement referral.

8. Changes

We may update this AUP from time to time. Material changes are announced by email to your registered address at least thirty (30) days before they take effect, except where a faster change is required to address an urgent security or legal risk.
